EstateGuru Lietuva, UAB is not authorised to provide crowdfunding services in Lithuania
UPDATED! Lietuvos bankas had previously published information stating that EstateGuru Lietuva, UAB is not authorised to provide crowdfunding services in Lithuania on behalf of Estateguru OÜ. Estateguru OÜ, an Estonian crowdfunding company offering its services in Lithuania, took into account the comments from Lietuvos bankas and adjusted public communication about its partner EstateGuru Lietuva, UAB. The latter’s activities are exclusively focused on maintaining client relationships and gathering of information needed for the assessment of crowdfunding projects in the Lithuanian market. Any complaints from consumers concerning actions or omissions by Estateguru OÜ should be addressed to the Estonian supervisory authority Finantsinspektsioon.
In response to publicly available information regarding the crowdfunding services provided by EstateGuru Lietuva, UAB (hereinafter, EstateGuru), and to ensure the effective functioning of financial markets and the protection of investors’ interests, Lietuvos bankas informs that EstateGuru is not authorised to provide crowdfunding services.
On 19 July 2023, at EstateGuru’s request, it was removed from the Public List of Crowdfunding Platform Operators maintained by Lietuvos bankas. In accordance with the new Regulation (EU) 2020/1503 of the European Parliament and of the Council on European crowdfunding service providers for business (hereinafter, the Regulation), no licence was granted to the company, as it did not apply to Lietuvos bankas for such a licence.
Lietuvos bankas also warns that EstateGuru’s activities are not supervised, so investors cannot apply to Lietuvos bankas for complaints and dispute resolution.
In Lithuania, crowdfunding services can be provided by companies licensed as a crowdfunding service provider by Lietuvos bankas in accordance with the procedure laid down in the Regulation, as well as by companies licensed in another Member State in accordance with the same procedure and whose intended crowdfunding activities in Lithuania are notified to Lietuvos bankas.
It should be noted that the Estonian company EstateGuru OÜ is authorised to provide crowdfunding services in Lithuania. The company holds a licence issued by the Estonian Financial Supervision and Resolution Authority (Finantsinspektsioon). Lietuvos bankas has received a notification from the Finantsinspektsioon about the intention of EstateGuru OÜ to provide crowdfunding services in the Republic of Lithuania. However, the authorisations held by EstateGuru OÜ do not grant EstateGuru the ability to provide services in the Republic of Lithuania on behalf of EstateGuru OÜ.
